In Peru, there are no specific rules that regulate employee monitoring. However, general laws may be applicable, such as:
- the Peruvian Constitution of 1993
- the Peruvian Civil Code of 1984
- the Peruvian Criminal Code of 1991
- Law No. 29733 on the Protection of Personal Data of 2011, and
- Supreme Decree No. 003-2013-JUS that approved the Regulation of Law No. 29733.
Additionally, Directive No. 01-2020-JUS/DGTAIPD on the Processing of Personal Data through Video Surveillance Systems, in force since March 16, 2020, is applicable for the processing of personal data through video surveillance systems and similar devices.
