The RGPC Platform became operational on November 25

RGPC platform now operational

The RGPC Platform (the “Platform”) became operational on November 25.

Under the General Regime for the Prevention of Corruption (the “RGPC”), established by Decree-Law 109-E/2021 of December 9, obligated entities (legal entities with their head office in Portugal and with 50 or more employees, as well as branches in Portugal of companies with their head office abroad and with 50 or more employees) are required to implement a regulatory compliance program. This program must include—at a minimum—a risk prevention plan for corruption and related offenses, a code of conduct, a training program, and a whistleblowing channel.

The Platform, which can be accessed by all obligated entities, provides a tool for submitting to the National Anti-Corruption Mechanism (“MENAC”) documents related to the regulatory compliance instruments provided for in the RGPC.

Accessing the Platform

Obligated public entities are automatically pre-registered to access the Platform. MENAC will communicate the pre-registration and access procedure via the email address provided to the Directorate-General for Administration and Public Employment.

Private entities — and obligated public entities that do not receive this communication — should request access by sending an email to registo@mec-anticorrupcao.pt.

Registration and document submission deadline

Entities must register on the Platform and upload all documents related to regulatory compliance by December 31, 2024.

With the Platform now in operation, entities no longer need to send MENAC the originals of documents sent electronically unless MENAC requests them to do so. If the obligated entities request to do so through the Platform, MENAC may exceptionally authorize documents to be sent in physical format—either on paper or on an optical disc.

Obligated entities that have already sent MENAC the required documentation by mail or electronically must still upload to the Platform the latest versions of the documents related to the regulatory compliance instruments provided for in the RGPC.
