Specialist in complex litigation with an international dimension, investment arbitration and commercial arbitration.

Borja Álvarez has participated in many litigation cases related to the energy and telecoms sectors, and disputes arising from M&A, construction and real estate.

He has participated in international arbitration cases brought under investment protection treaties (the Energy Charter Treaty and other bilateral investment treaties), and in international commercial arbitration cases. He represents clients before the ICSID, ICC, SCC, AAA, the Court of Arbitration of Madrid and the International Arbitration Center of Madrid (CIAM), and in ad hoc UNCITRAL arbitrations.  He also has experience in proceedings to recognize and enforce international decisions, including enforcements of investment arbitration awards. 

Borja Álvarez advises on private international law, including analyzing choice-of-law and dispute resolution clauses in all types of contractual documents. He participates in due diligence processes regarding claims and litigation portfolios, advising sellers and buyers, including funds acquiring litigation portfolios.  

Between 2017 and 2018, he completed secondments at the New York offices of US law firms Hughes Hubbard & Reed and Alston & Bird.

He is a member of the Madrid Bar Association (2011) and is admitted to the New York State Bar (2018).

He is a member of the Spanish Arbitration Club (CEA) and coordinator of CEA-40 (the CEA’s under 40 group) for 2023 and 2024.  

He is a member of the New York State Bar Association or NYSBA (International Section and co-chair of the Spanish chapter).

He is a member of the European Federation for Investment Law and Arbitration (EFILA) and of Young EFILA.

He is an associate lecturer of international arbitration and alternative dispute resolution in the Master in International and European Business Law at Universidad Pontificia de Comillas–ICADE in Madrid. 

He was a research and teaching assistant at the New York University School of Law in 2016 and 2017.

He speaks regularly at conferences on international arbitration and is the author of several publications and articles on international investment arbitration: 

  • Peer reviewer of the ICSID Review–Foreign Investment Law
  • Graduate editor of the NYU Journal of International Law and Politics (2016-2017)
  • Assistant editor of the European Journal of International Law (collaborating with Prof. Joseph HH Weiler, editor-in-chief) (2016-2017)
