Recientemente se publicó el Decreto Supremo No. 001-2022-TR – Decreto Supremo que modifica el Decreto Supremo No. 006-2008-TR, que aprueba el Reglamento de la Ley No. 29245 y del Decreto Legislativo No. 1038, que regulan los servicios de tercerización.
El Decreto Supremo introduce el concepto de “núcleo del negocio” para prohibir la tercerización de las actividades de la empresa principal, restringiendo sustancialmente el ámbito de aplicación de esta figura.
Debido a que estas restricciones se introdujeron mediante una norma de rango infra legal que contraviene la Ley de Tercerización y la Constitución, la legitimidad de esta norma podría ser cuestionada en la vía judicial o constitucional.
