Public Procurement

Lawyers specialized in advising bidders, contractors and contracting authorities on public procurement.

Our team has ample experience in all stages of public procurement procedures and in what are known as the “excluded sectors,” from the preparation of tender documents until the awarding and execution of contracts. We advise bidding companies on issues related to their offers in bidding procedures, as well as on issues and incidents arising from the execution, modification, readjustment, termination and settling of contracts.

Our experts in public procurement advise both tenderers and contracting authorities. Our team has extensive experience in all stages of administrative contracting, from the preparation of tender documents until the award of the contract, including any administrative and court appeals during the tender and award procedure.

Over the years, we have advised public authorities on drafting and reviewing general and specific administrative bidding conditions, and technical specifications, as well as on the most suitable social, labor and environmental clauses for the object of the contract. We also have ample experience in judicial reviews arising from the modification, repeal and termination of contracts.

We have unique expertise and experience in defending and representing our clients in administrative appeals (including specific ones corresponding to the bidding and awarding stage) and court appeals (including procedures before the Supreme Court, the Constitutional Court and the Court of Justice of the European Union).

Over the years, we have advised contracting authorities on drafting and supervising tender specifications and regulatory documents for their procurement procedures, as well as on strategic contracting and innovative public purchases.

We also have experience dealing with crossborder public procurement models and procurement procedures for EU institutions.

I am delighted with Cuatrecasas' way of approaching the issues, the control of legality and the experience in the matter.
