SubscribeNotice 4210/2024 was published in the Official Gazette of the Republic of Portugal on February 22. It approves the opening of the auction of biofuel certificates (“TdBs”) corresponding to biofuels introduced into consumption by small, dedicated producers (“SDPs”). The auction will be under the responsibility of the Directorate-General for Energy and Geology (“DGEG”).
Subject
The procedure auctions TdBs corresponding to biofuels introduced into consumption by SDPs that have benefited from the exemption from the tax on petroleum and energy products (“ISP”) under the Special Consumption Taxes Code (“CIEC”), issued by the National Entity for the Energy Sector (ENSE) in October 2023.
- A total of 4,486 TdBs will be auctioned.
- The base bid price is €398.93 per TdB (excluding value-added tax).
Eligible auction participants
Fuel suppliers—as defined in article 2.1.k) of Decree-Law 84/2022 of December 9, in its current wording—can participate in the auction. These are suppliers that introduce liquid or gaseous transport fuels into consumption by processing the declarations of introduction to consumption (DIC) or using the respective customs declaration upon import, in accordance with the CIEC, or any other entity responsible for paying the corresponding ISP.
Deadline for submitting bids
Bids should be submitted in a sealed letter sent directly to the DGEG’s premises within 15 business days after the notice is published in the Official Gazette of the Republic of Portugal. In other words, the submission deadline is March 14, 2024, at 5 p.m. The bid must include the desired quantity of TdBs and the bid value.
Award criterion
TdBs will be allocated based on the highest bids. If there are not enough TdBs to meet all bids, they may be apportioned among the bidders.
